LINGUA & PRAKTIKA or LINGUA & PRAKTIKA MEXIKO or L&P, Terms and Conditions
I.- GENERAL
I.1. - The client is responsible for reading and obeying the Terms and Conditions of LINGUA & PRAKTIKA.
I.2. - L&P does not discriminate the client according to race, sex, sexual orientation, religion, age, marital status, national and/or ethnic origin or disability.
I.3. - L&P affirms that all statements made on the website are faithful and correct. Every reasonable effort has been made to describe the program and the services provided. Therefore, the company cannot be held responsible for any changes due to circumstances outside its reasonable control. L&P undertakes the responsibility to advise the client of any material changes.
I.4. - Any participant who feels that there is a justification to request a change to any of the L&P's Terms and Conditions should address in writing to the L&P Management Director. Individual instructors or internship supervisors are not authorized to grant changes to the L&P's policies.
II. LANGUAGE
II.1. - In the rare case that there is just a single student in a level, L&P may offer private tuition without any extra charge. Course materials are included.
II.2. - In the case that a student applies for a Spanish course that is requiring a specific level and is unable to join the level after the course has already started, L&P will not refund money. In this case, the student will be given extra material to take home in order to reach the groups level. The student is responsible to join the level of the group.
II.3. - In the rare case that L&P is not able to give the students the programmed lectures, the course will be given in another language school or by a private teacher with similar standard.
II.4. - No lessons will take place on public holidays, and no discount will be given - except when specifically stated. It is the client's responsibility to check the list of public holidays.
III. HOUSING
III.1. - All accommodations are carefully selected for every client.
III.2. - A client may change the accommodation upon request providing a
valid reason that may endanger his health or safety. A host family cannot be changed if the clients' request is based on the discrimination of the host’s ethnic heritage, age, family unit or housing location. A client may not request more than one change during his stay.
III.3. - Where accommodation is proclaimed for one week, it refers to 7 nights from Sunday 1:00pm until Sunday 1:00 pm, unless a different agreement has been arranged with the L&P Management Director. If the participant spends less than 7 nights in his accommodation in any particular week, no discount will apply. For additional nights a proportional extra fee may be charged.
IV. INTERNSHIP
IV.1. - L&P endeavors to find an internship placement that relates to the client’s career and academic interests. However L&P can not always guarantee an exact match to the client’s preferences.
IV.2. - For the participation in the internship program LINGUA & PRAKTIKA charges an internship program fee of 190 EUR.
IV.3. - The intensive Spanish course takes place in the weeks before the internship. In exceptional cases it is possible to absolve the Spanish course parallel to the internship.
IV.4. - Cancellation through the participant: In the event that a client wishes to change his internship placement after the program has already started, a written request must be presented to the L&P Management Director giving reasonable and adequate reasons. Once the L&P Management Director has reviewed the request with the student and its internship supervisor, and has found sufficient reason to approve the request, L&P will make every effort to find an alternative internship placement charging an extra fee of 50 EUR to cover the additional administration work involved. After receiving a proof of the payment, L&P will start with the search of an alternative placement for the student to proceed his internship within the following two weeks.
IV.5.1. - Cancellation through the internship host for intern reasons: L&P can not be held responsible for the event that an internship host finds itself not able to carry out a confirmed internship program due to internal changes or unexpected events. In this case L&P will inform the student immediately and will make every effort to find an alternative internship placement within the following two weeks without charging any extra fee.
IV.5.2. - Cancellation through the internship supervisor: In the event that an internship supervisor finds the student’s working attitude or behavior unacceptable, he has the right to cancel the student’s internship program with prior notice to the L&P Management Director. In this case L&P is not responsible for providing another placement.
V. EARLY DEPARTURE
V.1. - The client is expected to follow the booked program. If an emergency situation forces him to leave the program prior to the end, L&P will make every effort to assist the client in making arrangements to go back home if this is what the case requires. L&P is not responsible of paying any of the arrangements.
VI. PAYMENT PROCEDURES AND CONTRACT
VI.1. - For the programs with internship a payment proof of the internship program fee is required in order to start the search of a placement. The internship program fee is part of the total amount of the booked program and is NO ADDITIONAL FEE. It will be deducted from the full payment.
VI.2. - In the rare event that L&P is not able to find an adequate internship, 100% of the internship program fee will be refunded.
VI.3. - The L&P programs without internship do not require a pre-payment.
VI.4. - The contract between LINGUA & PRAKTIKA and the participant will be sent to the participant by e-mail after he confirmed the chosen program.
VI.5. - The full payment of the program must be made at least 30 calendar days before the confirmed program starts (applies to all programs). In the case that the student makes the payment later than 30 calendar days before starting the program, L&P can not give a guarantee of keeping the program’s reservation.
VI.6. - Payments must be made by bank wire transfer.
VI.7. - The client is responsible to pay all bank charges incurring.
VI.8. - Once LINGUA & PRAKTIKA received the confirmation of the total payment, the student’s place in the program is reserved and his personal travel information will be sent to him by e-mail.
VII. RESCISSION
VII.1. - LINGUA & PRAKTIKA does not want to take advantage of possible problems that are out of the participant’s control and detain him from participating in the program. Therefore, if the full payment has already been made, L&P refunds 80% of the total program cost until one day before the start of the program.
VII.2. - After the program has started, there is no refund of the booked services.
VII.3. - In the case of cancellation the client is responsible to pay the bank charges incurring to provide the refund.
VIII. INSURANCE
VIII.1. - For the participation in the L&P programs it is obligatory to have a “medical health insurance plan” that covers the period of the stay in Mexico.
VIII.2. - The participation in an internship program requires an additional “third party liability insurance” that covers possible damages caused in the internship place.
IX. PICK UP SERVICE
IX.1. - Pick up service is included from the airport or bus station in Merida.
IX.1.1. - In the case that the student arrives in Merida by plane, he is responsible to inform L&P about his flight dates (airline, flight number, arrival time) in advance.
IX.1.2. - In the case that the student arrives in Merida by bus, he is responsible to inform L&P about the bus station and arrival time in Merida in advance.
IX.2. - In order to ensure the student’s reception in Merida, he is responsible for contacting L&P immediately by telephone if there is a flight or bus cancellation or delay. If the student fails to inform L&P about any circumstances that might influence his arrival time, the L&P representatives will possibly not be able to meet him at the airport or bus station. In this case the student will be responsible for the transportation to his accommodation.
X. OTHERS
X.1. - L&P reserves the right to modify programs, schedules, tuition fees, rules and regulations as well as policies without prior notice. Once the full payment is made, the prices will not change, even if they have changed on the website.
X.2. - In exceptional cases some extra activities can be substituted by other activities.
X.3. - Any special requests must be advised to the L&P Management Director in written form.
X.4. - The student is held legally and financially responsible for all property damages, injury to other persons and illegal acts committed by the student during the program. A student who causes serious: damage to property, injury to person(s), or commit (an) illegal act(s), will result in the immediate cancellation of all services and agreements between the client and L&P, without refund and the immediate exclusion of the student from the programs and facilities. In this case the student has to bear all the costs that are caused through this.
X.5. - LINGUA & PRAKTIKA is not responsible for lost or stolen money, jewelry, negotiable papers, credit cards, personal items, clothing, electronic equipment, perishable items or any other items at all times during his flight and/or during the participants stay. The student carries his items at his own risk.
X.6. - All parties agree that facsimiles or e-mails (attachments included) such as copies of application forms will be treated as originals.
X.7. - The contract incorporating these conditions shall be governed by Mexican law and shall be subject to the jurisdiction of the courts of Merida, Yucatan.
